Folks,
Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

Can i leave the employer while i-140 is pending.....???If emplyer assures me that he won't revoke the i-140...???
I would like to move to another job at the same time i would like to take some benift(PD) from the GC process i have been through so far.

I was checking the http://congress.org
I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........

My case is currently at the local West Palm Beach office in FL and I have moved to TX. I filed online AR-11 and change of address for my pending I-485 (EB3 India 2003). I received a letter stating:
After careful review of your request, it has been determined that your issues will be best addressed by the USCIS office having jurisdiction over your case. Therefore we have taken the liberty of forwarding your service request, number to the Missouri Field Office.
I don't know what the Missouri field office has to do with anything. What are my options at this point? Can I request them to not change the local field office (to minimize the chance of screwups)?

I am currently in Dallas. For applying a duplicate passport, it is OK if i Mail my application through USPS express mail which provides acknowledment . Can anybody please tell me if there is any problem with this?

Hi,
I heard that if the filing of the 140 /labor /485 (any of them) have the filing date < 1 year at the end of the 6 year of h1b then I can not extend my H1B for the 7th year.
Questin: Is this correct?
Details:
Filled labor in june 2007.
Filled 140 /485 in aug 2007
6th year H1B completed in feb 2008.
Question: Am I eligible for the 7th year h1b extension?
If yes then for how many years of extenstion I get?
If not then please suggest what to do.
Note : I have not changed my employer since last 3 years.

If I resign, If my employer cancels my I-140 and use that labor and PD for another person within next 3 months. Can I still use the same priority date if I reach to the I-140 stage in the next 9 months at the new employer?
I have a nice offer from a reputed company but am worried that my current employer (small-time consulting company) would revoke 140 for the purpose of substituting it...Otherwise they have no problem with me but then it is a business for them.
I asked them if it is not illegal/immoral to do that. Their reply was that it is illegal only to sell it and not if it is given away as a favor and they seem to have folks waiting on the sidelines...
I am waiting for that law to ban it but it does not seem to happen...

I finally got my BC from India, now my lawyer tells me that it should have Mothers maiden name, Is that right? I cannot find any info which says that.
Birth certificates formats are entirely local. In India each state; maybe even each district has its own format. Your lawyer may have seen some that has this information, or s/he simply does not believe you that what you got is the genuine one. In any case, USCIS does not (and cannot) require any specific format.

I just got back word from my lawyer saying that you shld be able to work with an expired EAD as USCIS would "backdate extensions of work authorisation" (provided of course that you have applied for the extension).
(I have been trying to upload the pdf, but can't seem to get it.
It's saved as a pdf on my local drive and am using the attachment icon provided, any help would be appreciated).
I know there are have been many nays on this subject and have asked my lawyer to provide more substantial proof (any memos or publications by USCIS).
Any comments on this?
